Health and Physical Education Legislation 2005
The South Carolina legislature passed The Student Health and Fitness Act 102* in the spring of 2005. Among other things related to health and nutrition, the legislation does the following:
Makes the state assessment program (SCPEAP) required K-12 and puts the scores on the school report card.
- Increases elementary PE time to:

60 minutes PE and 90 minutes PA in 2006-2007 (700:1 student/teacher ratio)

60 minutes PE and 90 minutes PA in 2007-2008 (600:1 student/teacher ratio)

90 minutes PE and 60 minutes PA in 2008-2009 (500:1 student/teacher ratio)

Requires fitness reports be sent home to parents in the fifth, eighth and high school.
- Requires an elementary school PE teacher to function as a physical activity director.
- Provides for assistance for poorly performing schools.
Required assessment of physical education programs will begin with Cycle 2 districts K-12 next year. Schools at all levels will be trained to collect data and align their curriculums with the state standards this coming year. Cycle 2 schools will collect data 2006-2007 and submit it spring 2007. The South Carolina Physical Education Assessment Program (SCPEAP) is designed to do statelevel assessment of physical education programs in South Carolina. The state professional organization, the South Carolina Alliance for Health, Physical Education, Recreation and Dance. (SCAHPERD), has been contracted by the South Carolina State Department of Education (SDE) to collect data on the extent to which students in South Carolina school programs meet the state standards. These standards are described in the South Carolina Physical Education Standards, which were approved by the Board of Education.
SCPEAP is an organizational structure of SCAHPERD. SCPEAP’s mission is to develop appropriate assessment material for the state standards and to collect and report that data for the SDE. Physical education assessment data is program data. Individual student scores will be combined to report the number of students at each school that meet the state standards.
